TERMS AND CONDITIONS
PEGASUS Whiteboard Products does not sell on approval or provide a free trial period. Any returns or exchanges must be done in accordance with PEGASUS’s return policy. Before you attempt to return your Product, you must contact PEGASUS directly to obtain a Return Authorization Number (RMA). RMAs will be authorized at the sole discretion of PEGASUS. The RMA is to accompany the return and the product must be returned to us in its original (or comparable) packaging. You are RESPONSIBLE for risk of loss, and any shipping and handling fees associated with the return or exchange of the product. PEGASUS will not accept returns for opened and/or used products unless they are defective and have been reported to us as defective within 48 hours of receipt. In these instances, PEGASUS will make an exchange. PEGASUS, at its sole discretion, may apply a twenty-five percent (25%) restocking fee to all returns. You must ship packages approved for return (RMA issued) within 7 days to the designated address. If you fail to follow PEGASUS’s return or exchange instructions, PEGASUS will in no way be responsible for any product that is lost, damaged, modified, or otherwise processed for disposal or resale. At the discretion of PEGASUS, you will receive a refund for the price paid of the approved return items excluding freight charges.

Buyer may not refuse shipment without prior approval and a cancellation number or a 25% restocking fee will be imposed. Any buyer canceling an order prior to shipment must obtain a cancellation number will be subject to the same 25% restocking fee. Buyer may return defective merchandise for exchange to PEGASUS Whiteboard Products, within thirty (30) days of receipt, provided Buyer obtains a RMA Number from Pegasus, prior to returning goods. All products that are shown to have been opened and or used, will not be accepted back (no exceptions) unless they are defective and have been reported as such within 48 hours of receipt. In the case of a timely reported defect, the product may be returned with an RMA.

REFUSAL of shipment.
If a customer has no valid reason for refusing an order that was to be delivered to them, then the customer will be responsible for both the initial shipping costs as well as the shipping costs incurred by Pegasus Whiteboards to have the whiteboard package(s) shipped back (returned) to our warehouse. Additionally, we will also charge a 25% Handling Fee to cover the additional costs of processing of the refused order.

Warranties.
We guarantee all products will ship free from defects in material and workmanship. If any product fails to perform under normal use, Pegasus Whiteboards Products will replace it. This warranty does not cover damage resulting for installation or any modification to the product by the customer.

Whiteboard surfaces are guaranteed for varying terms depending on surface materials.

Not included in the Pegasus Whiteboards Products Warranty are the following conditions: normal wear and tear, natural weathering or fading of hardware or finishes, including corrosion in highly corrosive environments, glass breakage, scratches, failure due to misuse, abuse, lack of maintenance, or by alteration to the board, improper handling, installation or maintenance, damage from settling or movement of wall or building, condensation due to excessive humidity levels in building, labor and materials for installation of a complete replacement product or any repainting or finishing required in connection with any warranty work, faulty installation, re-installation, and incidental or consequential damage.

It is the installer’s responsibility to make sure the structure to which the Pegasus Whiteboards are going to be installed can sufficiently support the weight of the Whiteboards. Improper installation can lead to the Whiteboard breaking or falling causing wall damage, damage to the whiteboard or personal injury. For detailed installation information, please refer to the instructions supplied with your Whiteboard product.

Except as expressly set forth above, Pegasus Whiteboard Products, makes no representations or guarantees of any kind, express or implied, in fact or in law, including, without limitation, the warranty of merchantability or warranty of fitness for a particular purpose. No person has any authority to bind Pegasus Whiteboard Products, to any affirmation, representation, or warranty concerning Pegasus Whiteboards Products ® except as stated in this manufacturer's warranty. Pegasus Whiteboard Products, liability and the purchaser’s sole and exclusive remedy from alleged defects in the materials or manufacturing of the Pegasus Whiteboards Products ® shall be limited to the replacement of an equivalent product or a refund of the invoice charged as Pegasus Whiteboard Products, may elect if payment has been made.

In no event shall Pegasus Whiteboard Products, be liable for any consequential or incidental damages, losses, costs, of expenses or any person of any kind (including without limitation, loss of profits or injury to credit, reputation, or goodwill) directly or indirectly resulting from any alleged breach of warranty contained in this Manufacturer’s Warranty. This Warranty shall apply only to the whiteboards being used under normal conditions and maintenance, and not for any failure due to misuse, mishandling, or vandalism. This warranty shall be limited to the furnishing of new whiteboards only and not to any labor or material to remove or replace.

Limitation of Liability
Seller’s maximum cumulative liability to buyer shall not exceed the monetary amount of the purchase price of the goods claimed to be defective. Buyer is not entitled to consequential or special damages.

SHIPPING POLICY
You will be able to view the TOTAL shipping cost of your order before the order is complete. Shipping and Handling charges provided at the checkout shipping calculator ("estimate shipping for this order") are the final shipping and handling cost to be charged for your order. There are no hidden shipping charges.

The prepaid shipping fee paid is for delivery to the consignee’s loading docks or curbside ONLY. The trucking company is only responsible for taking the freight to the back of their truck. It is your responsibility to take the freight into the building or home.

A signature is required for all truck deliveries; someone must be available during business hours (Monday-Friday 8:00AM to 5:00PM) to sign for a truck delivery. Please note any visible damage on the bill of lading/delivery ticket before signing for the shipment.

Shipping and handling charges are non-refundable for all returns

Shipping Charges; Taxes; Title; and Risk of Loss. Shipping is an additional charge unless PEGASUS expressly agrees and indicates differently at the time of sale. Any loss of or damage to the product that occurs during shipment by a PEGASUS approved courier is the responsibility of PEGASUS when reported to PEGASUS within 48 hours. Any loss of or damage to the product that occurs during shipment by a non-approved Pegasus will be your responsibility. PEGASUS is not liable for packages left at the recipient’s address without acceptance and or signature. Examine your order immediately upon delivery to ensure that there are no visible signs of damaged, missing or incorrect pieces. In the event that there are missing, damaged or incorrect packages, please retain the item(s), indicate the problem on the Delivery Note and contact us within 48 hours of your delivery. A signed delivery receipt, without notations of missing, damaged or incorrect item(s) represents your acceptance of the complete order in perfect condition. IF YOU FAIL TO INFORM PEGASUS ABOUT THE DAMAGED PRODUCT WITHIN 48 HOURS, YOU TAKE FULL RESPONSIBILITY FOR THE PRODUCT. You must claim any tax applicable exemption and provide proper documentation of same at the time of sale. Unless otherwise stated, you are responsible for all taxes and duties associated with any orders. Shipping dates are estimates only. Pegasus will not be responsible for delays in delivery due to events beyond its control, including shortage of inventories, transportation strikes, transportation failures or acts of God.

** Buyer shall examine all merchandise promptly on receipt thereof. Buyer shall notify PEGASUS Whiteboards Products of all claimed shortages or damaged merchandise within forty-eight (48) hours of receipt of goods. Failure to give such notice shall be deemed as an acceptance of the goods as of the date of shipment. Reversible Dry Erase Boards, Glass boards and Whiteboards are shipped out by truck and the shipping fee paid is to your loading docks or curbside ONLY. If your order comes to you by truck you have to open and inspect your order regardless of the appearance of the outside carton. Large objects such as Dry Erase Boards can be damaged during transit and it is your responsibility to inspect your shipment on arrival. We will replace any damaged product free of charge if it is signed for as damaged upon arrival.

Shipping schedules are estimates only which cannot be guaranteed because of the nature of our products, and material, labor and manufacturing conditions beyond our reasonable control. Under no circumstances shall Pegasus AV Products be responsible for any inability or delay in meeting shipping schedules or for any loss or damage (whether direct or consequential) resulting therefrom.

CANCELLATIONS: Cancellation will not be accepted on products that are not regular stock, which are in the process of manufacture or customization, or are ready for shipment. Orders for unique or specialty products are not subject to change or cancellation without written approval from Pegasus and upon the condition that Buyer pays Pegasus applicable cancellation charges.

APPLICABLE LAW
By visiting our site, you agree that the laws of the State of Illinois, without regard to principles of conflict of laws, will govern these terms and any dispute of any sort that might arise between us.
